Now that pornography is on the Internet, its political and social functions have changed. So contends Margret Grebowicz in this imperative philosophical analysis of Internet porn. The production and consumption of Internet porn, in her account, are a symptom of the obsession with self-exposure in today's social networking media, which is, in turn, a symptom of the modern democratic construction of the governable subject as both transparent and communicative. In this first feminist critique to privilege the effects of (...) class='Hi'>pornography's Internet distribution rather than what it depicts, Grebowicz examines porn-sharing communities and the politics of putting women's sexual pleasure on display as part of the larger democratic project. Arguing against this project, she shows that sexual pleasure is not a human right. Unlikely convergences between thinkers like Catherine MacKinnon, Jean Baudrillard, Judith Butler, and Jean-François Lyotard allow her to formulate a theory of the relationships between sex, speech, and power that stands as an alternative to such cyber-libertarian mottos as "freedom of speech" and "sexual freedom.". Derogatory terms (racist, sexist, ethnic epithets) have long played various roles and achieved diverse ends in works of art. Focusing on basic aspects of an aesthetic object or work, this article examines the interpretive relation between point of view and content, asking how aesthetic contextualization shapes the impact of such terms. Can context, particularly aesthetic contexts, detach the derogatory force from powerful epithets and racist and sexist images? What would it be about aesthetic contexts that would make this possible? The (...) article puts into aesthetic contexts both Absolutist and Reclaimer views about the power of derogatory terms, applying an inferential role semantics, developed for language, to both words and images. The Reclaimer’s position, that derogation is a matter of pragmatics, of use, emphasizes the context-sensitivity of the term, that is matters who says it, to whom, when, where, and why. Understanding derogatory terms used as hate speech helps to make this position clear. The Absolutist’s position, that no contextual variations can detach the derogation from these deeply derogatory terms, is developed here through attention to subordinating images in pornography. The article argues that art may be able to achieve the deviant interpretations that the Reclaimer needs to undermine the derogations while maintaining sensitivity and awareness of the history of oppression. Claims that pornography cannot be art typically depend on controversial claims about essential value differences (moral, aesthetic) between pornography and art. In this paper, I offer a value-neutral exclusionary claim, showing pornography to be descriptively at odds with art. I then show how my view is an improvement on similar claims made by Jerrold Levinson. ABSTRACTExperimentation is traditionally considered a privileged means of confirmation. However, why and how experiments form a better confirmatory source relative to other strategies is unclear, and recent discussions have identified experiments with various modeling strategies on the one hand, and with ‘natural’ experiments on the other hand. We argue that experiments aiming to test theories are best understood as controlled investigations of specimens. ‘Control’ involves repeated, fine-grained causal manipulation of focal properties. This capacity generates rich knowledge of the object investigated. (...) ‘Specimenhood’ involves possessing relevant properties given the investigative target and the hypothesis in question. Specimens are thus representative members of a class of systems, to which a hypothesis refers. It is in virtue of both control and specimenhood that experiments provide powerful confirmatory evidence. This explains the distinctive power of experiments: although modelers exert extensive control, they do not exert this control over specimens; although natural experiments utilize specimens, control is diminished. Most people care about animals, but only a tiny fraction are vegan. The rest often think of veganism as an extreme position. They certainly do not believe that they have a moral obligation to become vegan. Gary L. Francione—the leading and most provocative scholar of animal rights theory and law—demonstrates that veganism is a moral imperative and a matter of justice. Are property rights absolute? This paper attempts to reframe this question by drawing on insights from the field of social ontology. My main claim is that, even if we accept the most extreme view of the absoluteness of property rights, there are some non-normative conceptual limitations to these rights. The conceptual limitations are based on two claims about the nature of property rights and their subject matter, namely objects in the world: (1) property law regulates relations between persons through the (...) use of objects, and not relations between persons and objects; (2) even when owned, objects retain some of their ‘independent’, unowned, existence. Taken together, these claims confine property law to the institutional meaning that is given to objects, which is distinct from their social and natural meanings. Since property law defines objects in a certain way, it makes space for other social considerations but without the need to qualify property rights. (shrink)

Is moral responsibility essentially historical, or does an agent's moral responsibility for an action depend only on their psychological structure at that time? In previous work, I have argued that the two main (non‐skeptical) views on moral responsibility and agents’ histories—historicism and standard structuralism—are vulnerable to objections that are avoided by a third option, namely history‐sensitive structuralism. In this paper, I develop this view in greater detail and evaluate the view by comparing it with its three dialectical rivals: skepticism about (...) moral responsibility, historicism, and standard structuralism. Each comparison includes discussion of new work on moral responsibility and agents’ histories, and along the way I offer new arguments for preferring history‐sensitive structuralism, paying special attention to the view's explanatory power. The capability approach, originated by Amartya Sen is among the most comprehensive and influential accounts of justice that applies to issues of health and health care. However, although health is always presumed as an important capability in Sen’s works, he never manages to fully explain why health is distinctively valuable. This paper provides an explanation. It does this by firstly laying out the general capability-based argument for health justice. It then discusses two recent attempts to justify why health is distinctively (...) valuable from within a capability framework – these are Sridhar Venkatapuram’s conception of health as the central human meta-capability and, respectively, Norman Daniels’ embrace of the capability metric in his use of Rawls’ principle of fair equality of opportunity. The paper argues that none of these accounts succeed in providing a plausible justification of the value of health. Finally, the paper suggests an alternative more complex justification, closely tied to different but central element of the capability view, that captures the core intuitions of both Venkatapuram and Daniels’ accounts but without being vulnerable to the objections raised against each of them. This, the paper concludes, provides a promising ground on which the capability view on health justice should be founded. (shrink)

Conscience is an idea that has significant currency in liberal democratic societies. Yet contemporary moral philosophical scholarship on conscience is surprisingly sparse. This paper seeks to offer a rigorous philosophical account of the role of conscience in moral life with a view to informing debates about the ethics of conscientious objection in medicine. I argue that conscience is concerned with a commitment to moral integrity and that restrictions on freedom of conscience prevent agents from living a moral life. In section (...) one I argue that conscience is a principle of moral awareness in rational agents, and that it yields an awareness of the personal nature of moral obligation. Conscience also monitors the coherence between an agent’s identity-conferring beliefs and intentions and their practical actions. In section two I consider how human beings are harmed when they are forced to violate their conscience. Restrictions on the exercise of conscience prevent people from living in accord with their own considered understanding of the requirements of morality and undermine one’s capacity for moral agency. This article concludes with a consideration of how a robust theory of conscience can inform our understanding of conscientious objection in medicine. I argue that it is in the interest of individual practitioners and the medical profession generally to foster moral agency among doctors. This provides a prima facie justification for permitting at least some kinds of conscientious objection. (shrink)

The article seeks to explain why spontaneity, a concept that political theorists have given scant attention to, matters. It argues that it matters because it delivers a capacity for producing democratic change that is urgent to reflect on amidst a prevailing mood of grief over a democracy lost. To stimulate this reflection, the article engages with Rosa Luxemburg’s work, showing how her understanding of spontaneity as an initiative that delivers something for democracy lays the groundwork for a theoretical (...) orientation that allows us to notice the effects of spontaneity on democracy without overplaying its short-lived nature. There is wide agreement on its instrumental value and its favourable impact on many aspects of society, but less certainty over whether it has a non-instrumental or intrinsic value that can be demonstrated. In this project, Shlomi Segall explores and defends the view that it does. He argues that the value of equality is not reducible to a concern we might have for the worse off, or to ensuring that (...) individuals do not fall into poverty and destitution; instead he claims that undeserved inequalities, wherever and whenever we might find them, are bad in themselves. Assessing the strength of competing accounts, such as sufficientarianism and prioritarianism, he brings together for the first time discussions of the moral value of equality with luck- or responsibility-sensitive accounts of distributive justice. In ‘‘Why brains matter: an integrational perspective on The Symbolic Species’’ Cowley (2002) [Language Sciences 24, 73–95] suggests that Deacon pictures brains as being able to process words qua tokens, which he identifies as the theory’s Achilles’ heel. He goes on to argue that Deacon’s thesis on the co-evolution of language and mind would benefit from an integrational approach. This paper argues that Cowley’s criticism relies on an invalid understanding of Deacon’s use the concept of ‘‘symbolic reference’’, which he appropriates (...) from Peirce’s semiotic. Peirce’s analysis as well as Deacon’s appropriation will be examined in detail. Consequently it will be argued that an integrationist reading would add very little to Deacon’s core thesis. (shrink)

There are a number of recent attempts to introduce Confucian values to the ethical analysis of technology. These works, however, have not attended sufficiently to one central aspect of Confucianism, namely Ritual (‘Li’). Li is central to Confucian ethics, and it has been suggested that the emphasis on Li in Confucian ethics is what distinguishes it from other ethical traditions. Any discussion of Confucian ethics for technology, therefore, remains incomplete without accounting for Li. This chapter aims to elaborate on the (...) concept of Confucian Li and discuss its relevance to ethics of technology. Particularly, by referring to Li’s communicative, formative, and aesthetic function, I formulate an approach to ethics of technology with an emphasis on community, performance, and the aesthetic and demonstrate how this approach proceeds with the ethical analysis of technology. In this article, we present results from a literature review of intrinsic, instrumental, and relational values of nature conducted for the Intergovernmental Science-Policy Platform on Biodiversity and Ecosystem Services, as part of the Methodological Assessment of the Diverse Values and Valuations of Nature. We identify the most frequently recurring meanings in the heterogeneous use of different value types and their association with worldviews and other key concepts. From frequent uses, we determine a core meaning for each value type, which is (...) sufficiently inclusive to serve as an umbrella over different understandings in the literature and specific enough to help highlight its difference from the other types of values. Finally, we discuss convergences, overlapping areas, and fuzzy boundaries between different value types to facilitate dialogue, reduce misunderstandings, and improve the methods for valuation of nature's contributions to people, including ecosystem services, to inform policy and direct future research. © 2023 The Author(s). The motives of philosophers tend to be personal. Philosophy has mattered politically as part of continuing political debates. Its effects on politics, religion and the development of the sciences have been evident. Philosophy has been supposed to have special educational value, from its contents or from the benefits of its methods and arguments. This is doubtful. Rather, philosophy matters because its concerns matter. How much philosophy matters, or should matter, may be a question of local taste.

The first comprehensive philosophical examination of our duties to future generations, Dr de-Shalit argues that they are a matter of justice, not charity or supererogation.

An explanation is given of why it is in the nature of inquiry into whether or not p that its aim is fully achieved only if one comes to know that p or to know that not-p and, further, comes to know how one knows, either way. In the absence of the latter one is in no position to take the inquiry to be successfully completed or to vouch for the truth of the matter in hand. Fantastic spectacle was all that mattered.We speculate with the fantastic. Fantasy is a celebrity and money-making machine. As a module in our brains, it has the capacity to transform plain junk into gold that glitters. Fantasy mobilizes and instrumentalizes the fantastic to form and celebrate spectacles that exist and have always existed—illusions of social relations of exploitation based on power. Spectacles violate and drain our imaginations by glorifying social relations of power that are made spectacular and involve the magic of fetishism. Generally, the results bring about delusion and acclamation of particular sets of social relations that are commodified, sold, and consumed. We acclaim commodities that we don’t know, products that are not of our own making and that we consume mentally and physically. We reproduce images consciously and unconsciously that are not of our own making. The media and the corporate world occupy our psyches and manipulate our fantasies even when we [End Page 77] dream. Feminist standpoint theory has been marginal to mainstream philosophical analyses of science–indeed, it has been marginal to science studies generally–and it has had an uneasy reception among feminist theorists. Critics of standpoint theory have attributed to it untenable foundationalist assumptions about the social identities that can underpin an epistemically salient standpoint, and implausible claims about the epistemic privilege that should be accorded to those who occupy subdominant social locations. I disentangle what I take to be the promising core of feminist (...) standpoint theory from this conflicted history of debate. I argue that non-foundationalist, non-essentialist arguments can be given (and have been given) for attributing epistemic advantage (rather than privilege) to some social locations and standpoints. They presuppose a situated knowledge thesis, and posit contingent advantage relative to epistemic purpose. I illustrate these claims in terms of the epistemic advantages that accrue to a fictional character, from Neely’s novel Blanche on the Lam, who represents a type of standpoint invoked by diverse advocates of standpoint theory: that of a race, class, and gender disadvantaged “insider-outsider” who has no choice, given her social location, but to negotiate the world of the privileged while at the same time being grounded in a community whose marginal status generates a fundamentally different understanding of how the world works.
